Prince Sues Author For Writing “Rain” and “Purple” in Same Sentence

— Pop star Prince has filed suit against Pulitzer Prize winning author I. Wright Booring for using the words “rain” and “purple” in a sentence in her latest e-novel.

The singer, who starred in the 1984 movie “Purple Rain” and released a hit single by the same title, says he owns the rights to the phrase in any combination and that Booring used them in a single sentence without his permission. 

The sentence reads as follows: “I gazed out my window, watching the rain fall softly, marveling at the rich purple hue of the tulips in my flower garden.” 

Prince, 70, says he owns the rights to the words purple and rain, and is asking for a court order to have the e-book removed from online stores and libraries.

The eccentric rock star has a history of filing intellectual property suits, and usually ends up losing. In 2008, a Pennsylvania woman sued Universal Music Recording Group, which was Prince’s record producer at the time, after the company ordered YouTube to remove a video clip she had uploaded showing her 13-month old son dancing to Prince’s song “Let’s Go Crazy.”  A federal court ruled that Universal should have first examined whether the clip fell into the “fair use” exemption of federal copyright law before issuing the take-down warning.

In 2019, Prince sued Hershey for naming one of its most popular chocolate candies, “Kiss,” which is also the title of a Prince song. And in 2020, he asked a federal judge to order Unilever to rename its Dove brand of soap products, and Mars, Inc. to do the same with its Dove chocolate foods, claiming he obtained the rights to that word when he penned the hit “When Doves Cry.”  All those cases were dismissed.
